Welcome to pixdabble.com ("PixDabble", "we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and tools (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

1. Our Service

PixDabble allows you to generate fun, creative images of your pets in exotic or imaginative locations. You can upload photos of your pets, and our system will produce new digital images for you. PixDabble is for entertainment purposes only and the generated content is not a substitute for professional photography.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use the Services. If you are under 18, you must have a parent or legal guardian’s permission. By using PixDabble, you confirm that you meet these requirements.

3. User Content

  • You retain ownership of the photos and content you upload ("User Content").
  • You grant PixDabble a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your User Content solely to operate, maintain, and improve the Services, and to comply with legal obligations.
  • You are responsible for ensuring you have the rights and permissions to upload the User Content (e.g., you own the photo or have permission to use it).
  • We reserve the right to refuse, remove, or disable access to any User Content that violates these Terms or applicable law.

4. Generated Content

  • Images generated by the Services ("Generated Content") are created using automated tools and may not always be accurate, realistic, unique, or appropriate.
  • Unless expressly permitted by PixDabble in writing, Generated Content is licensed to you for personal, non-commercial use only. You may share it on your personal social media or with friends, but you may not resell, sublicense, or redistribute it commercially.
  • PixDabble does not guarantee the availability or permanence of Generated Content, and may limit downloads, resolutions, or storage at our discretion.

5. Prohibited Uses

You agree not to use the Services to:

  • Upload illegal, harmful, or offensive content, including content that is violent, abusive, or sexually explicit.
  • Violate the intellectual property, privacy, or publicity rights of others.
  • Generate or disseminate content for malicious, defamatory, deceptive, or fraudulent purposes.
  • Probe, scan, or test the vulnerability of any system or network, or attempt to breach security or authentication measures.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying models of the Services.
  • Use automated means to access the Services in a manner that burdens or disrupts our infrastructure.

6. Payments and Refunds

  • Some features require payment. By purchasing, you agree to provide accurate billing information and authorize PixDabble (or our payment processors) to charge your selected payment method.
  • Prices and features are subject to change. Taxes may apply based on your location.
  • Except where required by law or stated otherwise, all sales are final. Refunds may be issued at PixDabble’s sole discretion.

7. Intellectual Property

  • All trademarks, logos, software, user interface elements, and other materials of the Services are owned by or licensed to PixDabble and are protected by intellectual property laws.
  • You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code, except as laws prohibit these restrictions.

8. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and availability. PixDabble does not warrant that the Services will be uninterrupted, error-free, secure, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, PixDabble and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; and (d) unauthorized access, use, or alteration of your transmissions or content. In no event shall the total liability of PixDabble exceed the amount you paid to PixDabble (if any) for the Services in the thirty (30) days preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, to PixDabble, or to third parties, or for any other reason at our discretion. Upon termination, the rights and licenses granted to you will cease immediately.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting an updated version on this page or by sending you an email). Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the Terms.

12. Governing Law

These Terms are governed by and construed under the laws of The United Kingdom, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in The United Kingdom to resolve any dispute arising from these Terms or the Services.
